1. Acceptance of Terms
By accessing or using RemoteCloud9 ("Platform", "we", "us", "our") at remotecloud9.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.
These Terms apply to all users, including job seekers ("Candidates") and companies posting jobs ("Employers").
2. Description of Service
RemoteCloud9 is an online job board focused on remote developer and technology roles. The Platform allows:
• Candidates to browse job listings, create profiles, and apply to positions
• Employers to post remote job openings and review applications
• Both parties to communicate through the Platform's messaging and notification features
We reserve the right to modify, suspend, or discontinue any part of the Platform at any time with reasonable notice.
3. Accounts and Registration
To access certain features, you must create an account. You agree to:
• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password or authentication credentials confidential
• Be responsible for all activity that occurs under your account
• Notify us immediately at techcare@remotecloud9.com if you suspect unauthorised access
You must be at least 18 years old to create an account. Accounts created on behalf of organisations must be authorised by that organisation.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Candidate Terms
As a Candidate, you agree to:
• Provide truthful information in your profile, resume, and applications
• Not misrepresent your skills, experience, or qualifications
• Apply only to roles you genuinely intend to pursue
• Not submit automated, bulk, or spam applications
• Not use the Platform to harvest employer contact information for purposes other than applying to jobs
• Respect that employers may not respond to every application
Your profile information may be visible to employers who post jobs on the Platform. You control what information you include in your profile.
5. Employer Terms
As an Employer, you agree to:
• Post only genuine, active job openings for real roles at your company or a client company (clearly disclosed)
• Provide accurate job descriptions, requirements, and compensation information
• Not post jobs that are misleading, discriminatory, or in violation of applicable employment law
• Not use the Platform to collect candidate data for purposes other than recruiting for the posted role
• Respond to applications in a reasonable timeframe
• Remove job listings once a position is filled or cancelled
• Not post the same role as multiple duplicate listings
We reserve the right to remove any job listing that violates these Terms or our content standards, without prior notice or refund.
6. Prohibited Conduct
You must not:
• Post or transmit content that is fraudulent, misleading, defamatory, obscene, or illegal
• Impersonate any person, company, or entity
• Use the Platform for multi-level marketing, pyramid schemes, or unsolicited commercial messages
• Attempt to gain unauthorised access to any part of the Platform or other users' accounts
• Use automated tools (bots, scrapers, crawlers) to extract data from the Platform without our written permission
• Interfere with the integrity, performance, or availability of the Platform
• Upload malicious code, viruses, or harmful content
• Violate any applicable local, national, or international law or regulation
7. User Content
You retain ownership of content you submit to the Platform (profiles, job listings, cover letters, etc.). By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content for the purpose of operating the Platform.
You are solely responsible for the accuracy and legality of content you post. We do not endorse or verify user-submitted content.
We reserve the right to remove content that violates these Terms or applicable law.
8. Intellectual Property
The Platform, including its design, code, text, graphics, and branding, is owned by RemoteCloud9 and protected by copyright and other intellectual property laws. You may not copy, reproduce, modify, or distribute any part of the Platform without our prior written consent.
The RemoteCloud9 name, logo, and related marks are our trademarks. You may not use them without our prior written permission.
9. Privacy
Your use of the Platform is also governed by our Privacy Policy at remotecloud9.com/privacy, which is incorporated into these Terms. By using the Platform, you consent to the collection and use of your data as described in the Privacy Policy.
10. Third-Party Links and Services
The Platform may contain links to third-party websites (e.g. employer career pages). These links are provided for convenience only. We do not control, endorse, or take responsibility for third-party content or practices.
The Platform uses third-party services including Google OAuth (sign-in), Resend (email), and Upstash (caching). Use of these services is subject to their own terms and privacy policies.
11. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee:
• That the Platform will be uninterrupted or error-free
• That job listings are accurate, complete, or currently available
• Any employment outcome resulting from using the Platform
• The accuracy of any AI-generated content (cover letters, match scores, interview prep)
AI-generated content is provided as a tool to assist you. Always review and verify before use. We are not responsible for decisions made based on AI outputs.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, REMOTECLOUD9 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE PLATFORM.
Our total liability to you for any claim arising out of these Terms or your use of the Platform shall not exceed the amount you paid us in the 12 months preceding the claim (or INR 500 if you have paid nothing).
13. Indemnification
You agree to indemnify, defend, and hold harmless RemoteCloud9 and its officers, directors, employees, and agents from any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from:
• Your use of the Platform
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Content you submit to the Platform
14. Termination
We may suspend or terminate your access to the Platform at any time, with or without cause and with or without notice, if we believe you have violated these Terms.
You may terminate your account at any time by contacting us at techcare@remotecloud9.com or through your account settings. Upon termination, your right to use the Platform ceases immediately.
Sections 7, 8, 11, 12, 13, and 15 survive termination.
15. Governing Law and Disputes
These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in Hyderabad, Telangana, India, except that either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property rights.
If you are a consumer in the European Union, you may also have rights under EU consumer protection laws that cannot be overridden by contract.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Platform at least 14 days before the changes take effect.
Continued use of the Platform after the effective date constitutes acceptance of the updated Terms. If you do not accept the new Terms, you must stop using the Platform and may close your account.
